1. General Terms of Reference
1.1 These Terms and Conditions govern the installation, maintenance, and use of the Optiburner system.
1.2 Optiburner is a specialised energy-saving device designed to optimise boiler performance. As outlined in these terms, proper installation and maintenance are essential to ensure warranty validity and system longevity.
1.3 Funded Energy Solutions is responsible solely for the supply and installation of the Optiburner unit. We do not take responsibility for any part of the heating system or associated equipment beyond the installed Optiburner.
1.4 By agreeing to these terms, the client acknowledges the importance of proper installation, maintenance, and adherence to safety standards to effectively operate the Optiburner system.
2. Definitions
2.1 Funded Energy Solutions Ltd: The provider of the Optiburner, responsible for its design, distribution, and installation, and the holder of the Optiburner trademark and patent.
2.2 Optiburner: This term refers collectively to the Optiburner Dynamic Boiler Management Unit (DBMU), Optiburner Boiler Optimiser, or simply the Optiburner, all of which describe the same patented and original product.
2.3 Client: Refers to the individual, company, or organisation purchasing or agreeing to install the Optiburner.
3. Intellectual Property
3.1 “Optiburner” is a registered trademark of Funded Energy Solutions Ltd and is protected under applicable trademark laws. Any unauthorised use of the name or associated terms is strictly prohibited.
3.2 A Funded Energy Solutions Ltd patent protects the Optiburner. All rights are reserved, and any unauthorised replication, reproduction, or modification of the product or its components is prohibited.
3.3 The Optiburner is the only dynamic boiler management unit available. Any other devices claiming similar functionality are not original products and are not affiliated with Funded Energy Solutions Ltd.
4. Client Responsibilities
4.1 The client must ensure that the engineer has clear and unobstructed access to the boiler(s) and surrounding area where the Optiburner will be installed.
4.2 Access must be safe and compliant with health and safety standards. Failure to provide adequate access may result in rescheduling, additional charges, or delays in installation.
4.3 The client is responsible for ensuring that the boiler system works well before installing the Optiburner. Any issues with the existing heating system must be resolved before the installation appointment.
5. Installation Requirements
5.1 The Optiburner system can only be installed, configured, and supported by a qualified Dynamic Burner Management Unit (DBMU) Engineer accredited by Optiburner.
5.2 Accredited engineers are trained to ensure adherence to the latest UK safety regulations, reducing the risk of installation errors that could compromise system performance or safety.
5.3 Installations carried out by non-accredited personnel will immediately void the warranty and may lead to:
- Increased maintenance costs
- System malfunctions
- Potential safety risks
5.4 Accredited installations include issuing a mandatory safety certificate and confirming operational and safety standards compliance. This certificate is necessary to validate the warranty.
5.1 The client is responsible for ensuring clear access to the boiler(s) where the Optiburner will be installed. This includes providing sufficient space and removing any obstructions that may impede installation.
5.3 Interference with the Optiburner by any unauthorised or unqualified individual will immediately void the warranty and may cause operational issues with the unit and potentially the client’s heating system.
6. Warranty Conditions
6.1 The warranty for the Optiburner unit is contingent upon proper installation and maintenance by Optiburner-accredited engineers.
6.2 The warranty will be void if:
Unqualified individuals make any unauthorised adjustments, tampering, or repairs.
The mandatory maintenance schedule is not adhered to.
6.3 The warranty covers manufacturing defects and installation-related issues but does not cover damages resulting from:
- Improper use of the system
- Pre-existing faults in the heating system
- Third-party interference
6.4 The client is responsible for reporting any issues promptly to ensure warranty coverage and minimise disruption to system performance.
7. Mandatory Maintenance Package
7.1 The Optiburner requires mandatory annual maintenance for five (5) years to ensure optimal performance and compliance with warranty terms.
7.2 The maintenance package is priced at £280 + VAT annually for at least five years. The price is subject to adjustments based on market conditions, and clients will be notified in advance of any changes.
7.3 The maintenance package includes:
- Annual inspections to ensure safe and efficient operation
- Performance evaluations to identify and resolve potential issues before they escalate
- Adjustments to maintain compliance with safety and operational standards.
7.4 Additional maintenance visits, if required outside the annual schedule, are charged at £100 + VAT per visit.
7.5 Failure to adhere to the mandatory maintenance schedule will void the warranty and may lead to reduced performance or increased repair costs.
7.6 The maintenance package is a critical part of ensuring the longevity and efficiency of the Optiburner system.
8. System Usage and Safety
8.1 The Optiburner unit is designed for use with central heating boilers in compliance with UK standards. It must be used solely for its intended purpose.
8.2 The client must not attempt to modify or repair the unit without prior authorisation from Funded Energy Solutions or an accredited engineer.
8.3 Unauthorised interference with the unit may result in:
- Voided warranty
- Safety hazards
- Heating system malfunctions
9. Liability
9.1 Funded Energy Solutions accepts no liability for issues arising from:
- Pre-existing faults in the client’s heating system
- Improper use of the Optiburner system
- Interference by unqualified personnel
9.2 While Funded Energy Solutions takes every precaution to ensure safe and effective installation, the client is responsible for adhering to the outlined maintenance and operational guidelines to ensure system longevity.
9.3 In the event of a dispute, liability is limited to the replacement or repair of the Optiburner unit as deemed appropriate by Funded Energy Solutions.
10. Additional Support and Resources
10.1 For clients who require additional assistance, consultation, or training, Funded Energy Solutions offers support services at an additional cost.
10.2 Clients are encouraged to review the case studies and resources available on the Optiburner website to understand the benefits and proper usage of the system.
11. Updates to Terms and Conditions
11.1 Funded Energy Solutions reserves the right to update these Terms and Conditions to reflect regulation changes, pricing, or operational practices.
11.2 Clients will be notified of significant changes, and the updated Terms and Conditions will be published on the official website.
12. Governing Law
12.1 These Terms and Conditions shall be governed by and construed by the laws of England and Wales. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
